I find it very interesting how often the topic of secession comes up on this site in various places, especially the comments on the main columns.
I'm of the opinion secession's not possible. The Constitution spells out the mechanism for achieving statehood, but none for seceding or withdrawing. Like the Mafia, once in, never out.

Many years ago, a major newspaper (forget which one) ran an April Fools Day story that Montana did not actually exist, but was "created" to hide the fact that the United States was actually at war with Canada.
I firmly believe that the April Fools Day publishing date was simply a coincidence, and the story is true! Think about it!

The state would start out expelling all federal agencies from Montana.
Then they would close off Montana from all military bases. Kinda like Gitmo is closed off from Cuba.
Hmmm. What part of Montana's Gross annual income stems from feds?
Too bad Texas lost its Articles of Annexation when itlost the Civil War. Or it could divide itself into five separate states and ALL of them secede....

Do you think the left wouldnt use the military just because they were against attacking Respected House Member Bob McDermott's pal in Iraq? Nothing would make the Disarmacrats happier than to make a Chechnya-style sweep through the Big Sky Country. They could even emulate St Mikhail The Wonderful (Gorby) and drop exploding toys to blow the trigger-fingers off the hands of potential little gun-criminals. 'Our New Happy Life' is a slogan of Ingsoc; I'm waiting for Obama or Hillary to pick up on it. If any Dem is elected I'll bet our living Constitution will be discovered to contain a strict ban on individual gun ownership.

However.....
If the left get their way and "improves" America by making it a socialist nation, then their loathing of all things military will instantly vanish.
Has any far left regime EVER eschewed aggressive use of their military? Does the left cry foul as their pet leftist dictators worldwide field their militaries in threatening and imperialistic ways? Never.
The instant the military is a tool of the new socialist state, it will be enthusiastically embraced AND FREQUENTLY USED by the left in power.

and as far as I'm concerned, it's valid. There is this Indian tribe (with a valid claim of being here first) which as declared it's treaties with the USA null and void because the USA has broken the terms of the treaties. Some parts of like 4 States are no longer part of the USA, IMHO.

Tribes have been making this argument for a long time. In recent years it has had more to do with casino revenue then any real desire to hunt buffalo but I take your point. As I pointed out to Brian, here in Virginia we didn't do too well with it a while back but sovereignty used to be a much bigger deal in Washington than it is now. The borders are still open aren't they?

And the "Late Unpleasantness" aside, if you secede and win; then your success is the final answer to whether or not secession is legal or not. (On this point I disagree with BrianR.)
If Montana does secede, then maybe Mississippi will be the first to follow her example (just like in the "Late Unpleasantness" when Mississippi was the second state to secede after SC).
What I am seeing about SCOTUS's actions so far in this case (Hellor vs DC) are too vague. Maybe I have become "jaded" by years of Liberal PC "jargon"; but I am not wild about what I am hearing.

You are correct, the legality is in the winning. I am not particularly thrilled that this issue is before the court. Justice Kennedy can be a "loose cannon" (I hope you can forgive the pun) and he has been known to bring international law into decisions. He is swing vote but I wouldn't count him as a sure bet.

A straw man argument is defined as "Presenting a misrepresentation of the opponent's position and then refuting it, thus giving the appearance that the opponent's actual position has been refuted."
I never mentioned Mexicans or attributed any particular reason for Mexicans being in the country. I would include your usual "attack the [insert here] statement but to be honest I have no idea what your talking about. I thought the piece was about Montana?
