This is the second post

today that I've had to delay specific comments on a post because I have to reread at least once before commenting. I'll print it out and read it again later and keep the hard copy for reference.

Thank you Glenn for your research and hard work on this issue.It would be beneficial for all of us to have a better grip on our constitution and how we've managed to stray so far from the guidelines set forth for us by our forefathers.

My thoughts exactly. We, the people, because of the ammendment making senators elected by the people instead of the legislatures, no longer have a state professional watching over the way the gov't does things. Instead, the Senate is just like the House, susceptible to special interests and more power.

Looks like you put a lot of work into this one. this is a travesty how the constitution has been trampled over the years.

Glenn, Basically the Federal...

Government is giving itself powers not truly granted to it by the Constitution or by any legitimate reading of the Constitution.

But that means the states are also at fault for allowing this to happen. Perhaps the consideration by perhaps 42 of the 50 states of 10th Amendment Bills is a natural result of the states' not paying proper attention.

Justice Marshall, from all I have read, was not a "Constitutionalist". In today's world, he would probably be labeled a "neocon" or something similar. But whatever you want to call him, he pushed the SCOTUS in a direction that would gain it almost unlimited power. And he used that power to elevate the Federal Government to higher and higher levels of control.

Interestingly enough, if the Obamanation oversteps too "hard", I would expect more states than just the Deep South to revolt. I would also expect most of the West (except Hawaii, California, and Washington) and the Midwest (except perhaps Illinois) to join in. If 40 states revolt, who is the traitor and who is the patriot?

Actually, this all came from the annotations of just the first sentence in Article One. There are 374 pages of annotations for all of Article One.

I've still got a lot of work to do, although I believe Art. 1 has had enough of my attention.

You are absolutely correct. Again.

The states lost their ability to know everything when the legislatures lost the Senate via the 17th ammendment. That was the result Congress wanted by making Senators elected by the people. The Senate was supposed to be the State's watchdog over the Feds.

If we can get 35 or more states to pass the exact same resolution declaring all court rulings not in compliance with the letter of the Constitution to be void and of no power, we may actually improve our situation beyond expectations. And imprison some Congresscritters as well.

Wow. Great read and clearly you are hard at work on this issue. Our gain and my thanx.

IMHO, the Constitution as ratified with the first 10 amendments is an easy read. There is nothing complex about it. Am I wrong?

As for the States, the civil war squelched a good portion of State soevereignty and has led to their impotency. Today I fear there isn't enough Viagra on the planet to give ANY State the gumption to take up the cause of their rightful status in the union. Am I wrong?

On the 2 cases you cited, I notice that you quoted Marshall who was the Jeremiah Wright of his era. IMHO justices like Marshall are the problem.

No, you are correct in all you say. Sad commentary that justices such as Marshall have sought out and taken advantage of an absence of negatives, I mean not only does the Constitution specify what powers Congres has, Marshall sees that as NOT limiting because it doesn't specify what it CAN't do in all cases.

Criminal acts should not go unrewarded.

He should have gone to prison for his illegal rulings.

Our Constitution

As Bobbie noted in her post, this essay requires serious thought and study, Glenn. IMO, So much of what has happened in the last six months is sadly, unconstitutional. Thank you

I am glad that my writing is causing so much thought, we should carefully be considering everything going on in our nation.

You and I, and other people who give a hoot, plainly see the divergence taken from the Constitution's intent and wording but the courts have used innuendo and outright usurpation to "nuance" the road to where anything goes and the people get run over.
