One big reason for the rising cost of health care is the explosion of malpractice lawsuits. These legal actions not only boost the cost of malpractice insurance for doctors, but force unnecessary tests and other procedures for physicians who must practice defensive medicine.

Why, then, won’t Congress fix this irrational system as part of health care reform? The big reason is the influence of trial lawyers on the Democratic Party, and their hundreds of millions of campaign contributions. The Democrats have become the party of lawyers, for lawyers, and by lawyers.

Of recent Democratic nominees for president and vice president, five out of six have been attorneys—Obama, Biden, Kerry, Edwards, Lieberman. Of the last six Republicans on national tickets—McCain, Palin, and Bush and Cheney twice—none have been attorneys.
