It is the FLAGPOLE that is against the HOA regulations, NOT the flag.
As for the law Debbie cites, as I read it it says anyone has the right to fly the flag on their property, HOWEVER:
Nothing in this Act shall be considered to permit any display or use that is inconsistent with--
(2) any reasonable restriction pertaining to the time, place, or manner of displaying the flag of the United States necessary to protect a substantial interest of the condominium association, cooperative association, or residential real estate management association.
A reasonable restriction to the MANNER OF DISPLAYING THE FLAG OF THE UNITED STATES.

I think there should be a special provision for soldiers and veterans. Under no circumstances should they ever be harrassed about displaying an American Flag and showing their patriotism. They deserve more respect!

You have hit the nail on the head. Some things like painting your house purple could certainly be considered offensive. What kind of people would ever consider an American flag aesthetically offensive. It is the symbol of our country and its freedoms. It is what many fought and died to defend. What is really distressing is that it seems many are jumping on the Obama bandwagon and considering us a mean country that should be ashamed of ourselves for all our past beliefs. It is very scary when people fight to remove a flag after others fought and died to defend it.

There should be medals awarded for being a patriot and fighting the system in civilian life in America. There is just as big a war here at home as there is overseas. The only difference is, it is illegal to defend yourself.

Probably because it's a "legal battle" with a homeowner's association.
If I were to join a club that required me to wear a coat and tie within the premises, then showed up in blue jeans and an American flag-patterned polo, none of those organizations would come to my aid when I got kicked out for not following the rules.
Almost everyone seems to be forgetting the colonel was well aware of this rule before he ever bought the house.

Greg Hengler and Town Hall know perfectly well that trial lawyers have nothing whatsoever to do with this, and "Democrats," well, who knows? But hey, what difference does that make? Well , in this case it could have gone to a community vote. If the gentleman is in a patriotic neighborhood, they might stand behind him on this. These people arent enforcing issues of violent criminal behaviour. And many times these rules get added to deal with one problem at some point.
Newest Rule being imposed in my neighborhood? Thanks to one malicous cat that gets into other peoples homes (through cat/doggie doors etc), all cats must now be on a leash outside...silly?

It's too bad, but these homeowner associations are ruled by a few members on a board and the rules are rigid. It's part of the deal when moving into these neighborhoods and it's not confined to waving flags from a flag pole - or putting up Christmas decorations - in order to oppress seemingly rightwing ideology, as this post on Townhall does in a rather thinly veiled manner.
Of course Mr. Barfoot should be able to fly his flag proudly, and there is no doubt he will. But please don't paint this as an anti-flag, anti-patriotic rant.

Yes, this is an HOA neighborhood. But in our state, HOAs have virtually no legal authority or powers of enforcement. So, however he got the OK to have his flagpole, (or, knowing him, it would have likely been a matter of 'or not'), he's got it.
There are, to my mind, bigger battles to fight. The next owner can, after all, remove the pole if he so desires.
The colonel should be permitted to have his flag, and should receive the gratitude of his neighbors for his service, instead of the harassment of thin-skinned legal-eagle...
