Under most state penal code sections dealing with justification for the use of force and/or deadly force there is a stipulation that, even though one is totally justified in using force against an aggressor, the justification does not extend to cover the individual if he inadvertently injures or kills an innocent third party. If given an opportunity allowing a good clear shot at a shooter an armed person would be justified in “punching the bad guy’s ticket”. However, he (especially a peace officer) should be extremely careful, and ready to accept blame if he does accidentally injure or kill an innocent. [W3]

If 5 people had hand guns in that audience, even if they accidentally shot a few people, it could have cut the carnage in half. I would rather be killed accidentally by someone trying to save lives than murdered by a leftist nut with a PhD.

That law should make an allowance for extenuating circumstances, a rampage situation like that movie theater or Columbine. In that case there should be no prosecution if someone gets hit with friendly fire, because the death toll will be massive if the killer is not taken out.

Just to be clear, if one of my loved ones was in that theatre and one of the patrons had a gun, I want that patron to try and take the killer out before he can kill my loved one, and if a stray bullet hit my loved one and killed them, I would not hold the patron responsible. I would know he or she tried to prevent a mass murder and sometimes in that situation friendly fire, just like on the battlefield, is a possibility, but that doesn't mean we don't try to kill the enemy.

I would venture to guess that the folks filing in to see the latest Batman installment in Aurora, Colorado last Thursday evening didn’t figure on over 70 of them getting shot before the credits rolled. The last count I received before filing this column was 12 dead and 59 wounded.
