Under most state penal code sections dealing with justification for the use of force and/or deadly force there is a stipulation that, even though one is totally justified in using force against an aggressor, the justification does not extend to cover the individual if he inadvertently injures or kills an innocent third party.
If given an opportunity allowing a good clear shot at a shooter an armed person would be justified in “punching the bad guy’s ticket”. However, he (especially a peace officer) should be extremely careful, and ready to accept blame if he does accidentally injure or kill an innocent.
