Actually, Kagan & Sotomayor would not be on the court were it not for Barry Hussein Obama,Jr.-Soetoro aka, Barry Soetoro, thus no recusal is necessary. A recusal can only be done if someone legitimately holds the seat. Since Barry is not constitutionally eligible to be president, then he has no right to propose any nominee(s) for any position, thus, when it is determined that his presidency was a farse, there will be either a whole lot of blood letting, or a need to further amend the constitution with a determination on what must be done in regards laws he passed, monies he requested and spent, etc., and same for any future president elected without bona fides.

Once restitution is made, if it ever can be, they may assume their role as secnd class citizens for their failure to promote a lawful candidate. Also, the party who submits the candidates nomination must also aid in restitution of the debt(s) accrued under any illegitimate presidential candidate who assumes office under their banner, and who then tries to destroy the country thru malfeasance, and criminal behavior(s).

Further, there is going to be a need for a federal law which states what criteria a prospect for president must follow to prove his credentials, that without proof no election board may approve a run by said candidate, that no approval to be on the ballot may ensue without such, that no electoral college may vote for, and be held solely responsible (meaning both for failure to approve a bona fide candidate, and for actions taken by them while in office, including monies which may have been spent on his/her behalf) which means, they will have to foot the bill for the fraud they allowed to be perpetrated. That means they will either have to be jailed for being complicit (accomplices), or be fined for the rest of their lives, if necessary.

The President’s latest tactic, taking on the Supreme Court’s power of judicial review with a preemptive striking against justices who might contemplate an unfavorable ruling on ObamaCare, following on the heels of last week’s "open mic gaffe" in which he explained Russian President Dimitri Medvedev that he’d have more “flexibility” to sacrifice American security after his re-election, lead to one question: Is Barack Obama making his own case for impeachment?
