This is completely normal for a lawsuit to proceed against the estate of a deceased. The executor of the estate is the proper party to substitute and she is not being sued personally. This is not a lawsuit against a grieving widow. Moreover, the estate is likely flush with cash as a result of book sales, thus, it makes sense to pursue the case despite Chris Kyle's death. Maybe if Katie had gone to law school she would understand this, after all it is explicit in the language she quotes from the judge. If Chris Kyle lied in his book and falsely accused Ventura of a crime (i.e. public fighting), the libel is per se and Ventura does not have to prove damages.
