In the SCOTUS Heller case, 5 justices ruled that the Second Amendment was a fundamental right and that the right to bear arms is to be treated the same as First Amendment rights. The ruling stated that the"artful language" of the founding fathers on these fundamental rights applied to the "free state"; individual rights. The troubling part of the Heller ruling is that four justices interpreted the Bill Of Rights as "collective rights".
