I didn't just pull 40% out of thin air. It's the result of studies that are questioned with respect to their methodology and timeliness. I simply pointed out that, even if the number is much lower (which the article fails to specify the exact rate they believe is more appropriate) most of us don't find the loophole between private sellers appropriate to utilize at gun shows or other places where you're competing with licenses sellers.
The proposal to eliminate that particular exception doesn't apply to "word-of-mouth" sales, which covers selling your gun to your buddy privately. But there is NO reason why private sellers should be able to advertise
