By the way, churches and synagogues can already start something different without eliminating marriage from law. They can have a list of requirements before performing a ceremony, let's call it "Holy Matrimony", do a ceremony without a state license, recognize that covenant, and treat the couple accordingingly. Others can treat that couple accordingly, as well. Of course, this only works if 1) the people involved care about the "rules" of the religion, and 2) the religious organizations stick to their guns. All too often, a minister will say, "I won't marry a couple that is shacking up." and the couple simply goes to another church that will.
