The supreme court has upheld the social security law and its various portions in a few cases in the 30's. The Medicare act was passed as an amendment to the social security law, but well after the supreme court rulings I could find. (don't know if that means anything) Just recently, the court refused to hear an appeal by Armey's group of a lower court ruling that said one could not opt out of medicare, even if they wanted different and better insurance or if financially capable of covering costs.
