It is patently absurd to make it a crime for legislators to introduce legislation which you consider unconstitutional. Regarding flag burning, the Supreme Court declared in Texas v. Johnson, 1989, that flag burning in itself is protected speech and that a Texas law criminalizing such activity was therefore inconsistent with the First Amendment. So if legislators should be jailed for introducing legislation which might violate the Second Amendment why not the same with regard to the First Amendment?
