I reiterate--you have no expectation of privacy in your backyard, nor in any other public place. You have no freedom from aerial surveillance, because you do not have infinite air rights over your property, and under the open skies policy the U.S. has followed since the development of the airplane, anybody flying over your house can take a picture of it.
