"Interpretation and application of the Constitution is never as cut and dry as Conservatives like to pretend." So says the Amicable. And this begs the question. The very issue is whether the constitution means what is says, and whether supreme court justices should simply give us the benefit of their vast wisdom and do what they believe to be correct. This issue (judicial activism) is a slam dunk. The amendment process is available so that necessary change can be made to meet new circumstances. Circumventing this process, no matter who does it, is tantamount to tyranny. This is not exaggeration, it's simple fact. Check the dictionary. Anybody interested read Thomas Sowell's "Judicial Activism Re-visited."
