The Progessive movement of the first half of the 20th century specifically pushed an anti-Constitution viewpoint. The little known fact is that the Supreme Court found (5 to 4) the New Deal legislation of FDR's first 100 days to be unconstitutional based on the separation of powers doctrine. Basically, it was, because it delegated law-making ability to unelected agencies. Since the Dems had super majorities in both houses, FDR threatened to pass legislation that would expand the Court from 9 to 11 and send up a test case. Another little known fact, Congress sets the number of justices, it is not in the Constitution. (cont)
