70 or 80 years ago the Supreme Court decided that anything that involved interstate commerce could be controlled by Congress. This has evolved to anything that could involve interstate commerce and has allowed the regulatory agencies to do just about anything. That's why local sale of raw milk to neighbors is treated by the FDA as equivalent of forcing a child to drink mercury, light bulb prices are outrageous and toilets commonly have to be flushed twice.
