Just saw Jay Carney commenting on this court's decision as being unprecedented. That both parties made recess appointments for decades. The court's decision was that indeed congress was in session when the appointments were made by the Obama administration. At the time if I remember correctly, President Obama declared that congress wasn't in session and then made his appointments. Both parties have used the proforma session to deny the sitting president the ability to make a recess appointment.
