The "technicality" you have a problem with is the Adjournments Clause, not the pro forma sessions - a "technicality" created by Democrats during the Bush Administration. If one chamber of Congress wants to go on recess for more than 3 days, it must obtain the formal consent of the other. That's the law. This court didn't make it up.
