It's true that a lot of information sharing with regard to medical records requires patient consent or a subpoena (or, in the case of mental health information, a court order), but remember that Obama's goal is to have an electronic medical record within five years of passing the ACA and that record would be able to be accessed nationwide. Of course, that's probably impossible since there's no national standard for the EMR and many of these current programs don't talk to each other. There's already a court decision (Tarasoff) which requires psychiatric professionals to report to law enforcement if a patient threatens others and that particular information doesn't need patient consent.
