Let me counter as an attorney that there are, in fact, people in jail for simple possession. It is very true that first time offenders get a small fine or placement in drug treatment. People who do go to jail for possession are really going because they angered the police or the judge but I am at a loss as to why people who believe in the rule of law consider arbitrary enforcement to be a feature rather than a bug. If it really is as bad as she says, why isn't she calling for strict enforcement rather than clinging to the status quo? She seems to be conceding that locking up users is a waste just as she concedes that marijuana has real medical uses.
