The 2008 Heller decision has already settled the matter of semi-auto weapons. It upheld individual rights, but unmentioned in all the yammering today are the other things that court decreed. It held that the Amendment's purpose is to protect defense of self, family and property, that banning an entire class of guns is unconstitutional, that the types of guns protected are those suitable for military combat and those in common use by the people, and that the Amendment is the highest of rights inviolable by government even if there is a rational basis for its infringement.
