Unfortunately, the great hole in our Constitutional process lies in the "executive orders." Beginning with one or two by our first presidents, which merely ordered the lowering of the flag or the firing of gun salutes on the death of a president, executive orders were used by Lincoln for his war orders, as well as debasing the currency by issuing "greenbacks' instead of legal tender (coins). FDR issued more than 3,500 while taking the country off the gold standard and creating his New Deal. An executive order has to be challenged, go up through appeals courts to the Supreme Court, and be ruled upon for its constitutionality. I believe Obama has already issued over 900, none of which have been challenged.
