The mother had a choice in whether or not she engaged in the sexual behavior that led to her pregnancy, but the child had no choice in its creation. As such, the mother is responsible for the child. There isn't technology available today that can provide that sort of certainty. Therefore, removing a child before it is capable of survival is murder on the part of the consenting mother and the abortionist. The state's (noticed that you put "state" in CAPS) obligation here is to prosecute the crime. It's like throwing an unarmed person into a lion's den and telling them "to survive if they can."
