The question is one of government recognition that there are some rights and institutions like marriage that predate government and which should be off-limits to government control. This is just like the original 10 amendments known as the Bill of Rights, which established certain ideas that stem from humanity itself rather than government, such as the right to freedom of expression and religious affiliation (1st Amendment) and other rights to protect oneself from the government (2nd through 9th Amendments), and the limit of government (10th Amendment). Given all this, the Federal government should have no say in marriage.
