I thought that you had given up... The ICC was NOT the thin constitutional cover for the IHC it was justified by Eisenhower on the basis of 'providing for the national defense' (moving military equipment around) AND on the 'postal road' authority (old interstates signs still bear 'postal route' prefix on the signs)... The ICC by the way, if one actually READS IT, states something FAR different than most assume.... It ONLY grants the federal government to regulate trade AMONG THE STATES, not among people or businesses.... It constrains the exercise of authority of STATE governments ONLY, it doesn't actually extend authority to the federal government to regulate commerce among people or business (even if it crosses state lines)...
