I recently had a civil case negotiation that was gridlocked until I stood up from the table and said, "We'll take our chances in front of the judge." No sooner had I left the room than they capitulated to our position. PS: I actually did not want to go in front of the judge as our position had the possibility of getting awarded nothing but they were vulnerable to getting socked with far more than I was asking for. The best negotiating device is to not negotiate and appear unreasonable.
