And if a city does it, what difference does that make with regards to undo hardships on small or start-up businesses in said cities? It doesn't. However, that's not the point. The difference is that there is no constitutional authority for the feds to do it. A city can impose all of the ridiculous rules it wants; knowing that the citizens of that city will have their hide come the next election-something not easily done on a national level.
