Lee was never imprisoned. Some wanted to charge him with treason but the terms of the surrender to Grant prevented such charges as long as Lee acted with good behavior. When President Johnson pressed for charges aginst Lee, Grant hotly protested and stated, "I will resign the command of the army rather than execute any order to arrest Lee or any of his commanders so long as they obey the law." Lee was a model citizen after the war and applied to have his voting rights restored.
