What the Senate needs to do is take a step back in time and instead of just indicating a filibuster, require that the person who wishes to filibuster actually get off his rear and talk without stopping. No water breaks, no bathroom breaks, nothing that would cause the person to have to stop, save for a cloture vote later in the marathon. Sure, that grinds the Senate to a halt, but, it also would give the party wishing to filibuster pause in knowing that they can't merely stop a bill by telling the leadership that they are filibustering the bill, thus forcing a cloture vote to even discuss the legislation.
