The fault here rests with the Congress of these United States. Under the separation of powers it is congress that is charged with passing laws and controlling expenditures. Congress has become a collection of politically impotent but well paid individuals whose primary concern is avoiding the responsibilities of their office, which might lead to controversy, so they can stay in office and keep the good times rolling. Violations of the law should be met with stoppage of funding and failure by the executive to enforce the law with impeachment.
