Harry Reid made the statement on the floor of the Senate. Under Senate rules (as part of the Constitution) any statement made on the floor of the Senate is not subject to libel laws, nor to slander. He was also staying clear of the libel laws by stating that he had heard from "someone" about the taxes, thus he is not making a statement himself. The burden of proof is also very high since Mr. Romney is a public figure, it is higher than if Mr. Reid had made the same statement against you or me.
