I would submit to you that, for all practical purposes, we do not have a death penalty. When more people are dieing on death row from natural caused than are being executed the system is not working. For those who want to say it is against God's will and we only bring ourselves to the same level as the murderer, the Bible is full of examples where God commands the death penalty for certain crimes. When I was a child, born in 1949, people were afraid to kill anyone because the penalty came much faster and the thought of frying in an electric chair scared everyone. I agree we should have overwhelming evidence to perform this act but in the case of CO, I think it is there.
