The proper decision should have been to declare it a tax, and return it to congress to be passed as a tax. If it were truly a law that held up to the light of its true intent, it would have then been ammended, and passed into law. In this way, he would not have been "striking it down" but returning it to congress for more work before allowing it to become the law of the land. That is supposed to be the job of the supreme court.
