If government took equality under the law seriously there would be no subsidies, for subsidies require one producer to be taxed extra so another producer can be given welfare. Equal protection under the law went out with the Progressive Movement. It was a quaint nineteenth century idea in which government acted as an umpire enforcing rules equal to all. Today government is a player-manager directing and orchestrating the entire economy. Everyone recognizes this or else we would quit expecting presidents to cure the economy or banks to print stimulus money.
