Not having the death penalty isn't a deterrent either. Sociopathic people don't really seem to consider the threat of death to be an issue when they cold bloodedly murder someone. The idea that a sociopath may be housed and funded by the state via tax payer dollars seems less kind to me than the death penalty both for society and the murderer. Your enemy will not determine that you are kind when you fail to kill him on the battlefield. He will see it as another opportunity to kill you when you are unprepared. The death of one murderer is ultimately a deterrent because one murderer ceases to be.
