It did not speak of those people specifically enough. It used vague terms like "senior operational leader", "imminent threat of violent attack against the United States," and "capture is infeasible." How are these defined and can a clever government operative twist this to be an American in the region that owes a lot in back taxes because he fits the criteria in an economic sense and because the IRS says so ...
