N^2: Excellent point. If tax rates go up today, we can hope to take them down again tomorrow. On the other hand, Supreme Court justices (like herpes) are for life! That kind of issue is worth a fight. So is staving off a potential gun grab. So is, I believe, preventing a grant of citizenship and voting rights to millions of illegals. A handful of other things that Obama may try to do by decree are in the same category: worth a fight because the damage would be irreversible.
