No it is not for real The case he is referring to was lost by the birthers in circuit court It was appealed to the SC and denied a hearing by justice Kennedy It was re-appealed and as with all cases re-appealed it gets put on a list There are more than 10,000 cases on the list A staffer not a justice writes a brief summary of each case on the list and the justices meet in feb to pick about 100 cases from the over 10,000 on the list This case selection is the so called Hearing he is referring too Now birthers won't believe what I just wrote but what can you expect from them

It could happen--Barack Obama and John Roberts in an epic clash. For institutional, ideological, and personal reasons, the two charismatic heavyweights may be on a collision course.

Obama is a fierce competitor who climbed the ranks from local Chicago pol to president in just 6 years. He envisions a different American society--more liberal and redistributive, with a government powerful enough to make it happen. His ambitious Second Inaugural prompted even the New York Times to fit into print “Obama offers liberal vision.”
