What we do is turn to the ultimate power the framers gave us - amendment. The only way to return the federal government to its original constitutional limits is constitutional amendments restating and re-affirming those original limits on federal power. Of course, Congress will never initiate such amendments. Therefore the first step is to reform the amendment process so that the states can initiate and enact amendments without having to go through either Congress or the unworkable and outmoded mechanism of a convention. The solution must go deeper than simply replacing this arrogant ideologue. Much of the Obama administration's ability to wreck such havoc comes from a constitutional jurisprudence which has allowed the national government to expand far beyond its proper constitutional bounds. We can only hope to be free of this or future administrations of its ilk when we restore the original limits on the national government. Overturning Obamacare would certainly be a good thing, but it would still leave in place the prior 75 years of Supreme Court decisions which have enabled the growth of the national government far beyond its original constitutional limits. We need to amend the Constitution to restore those original limits. Of course Congress will not initiate such an amendment. Obama is not dumb, but he lives inside a leftist bubble where only neanderthals oppose the beneficence of Big Government, and the Constitution is just something you stretch however you need to empower more Big Government. And since the FDR Supreme Court ripped a huge hole in the interstate commerce clause to enable limitless Big Government, there have been only two very narrow small instances where the Supreme Court tried to tighten the edges of that gaping hole. Even if Obamacare is overturned, that will still leave in place the last 75 years of Supreme Court precedents for Big Government. Obama has no problem when the courts strike down a law he doesn't like, such as the Arizona immigration law.The difficulty with judicial review is not that it allows the Supreme Courts to force the Congress to follow the Constitution,a good thing. The problem is who makes the Supreme Court follow the Constitution? The framers' answer is the people do through the amendment process. Unfortunately, the amendment process has become moribund, and the courts can interpret the Constitution however they want without check.
