This issue is comparable to forcing insurance companies to cover pre-existing conditions. The impact is the creation of a public good (although this is where the two concepts diverge because it is arguable that restricting competitive currencies is not a public good) with the burden carried by insurance companies. This is what the Fifth Amendment is about -- "...private property [shall not] be taken for public use, without just compensation." So, while it may be popular to force insurance companies to cover pre-existing conditions, it is clearly unconstitutional, unless the government pays the insurance companies. Otherwise, it is comparable to taking away Mr. Von NotHaus's business.
