The writer talks about how most people "assume the risk" of certain activities. Assumption of the risk can be a defense in a products liability case. I don't know what the law in Montana is, but generally, baseball players should know that there are inherent dangers in the sport. However, a bat manufacturer might have a duty not to make the inherent danger of game greater than it should be. There are several ways to determine the reasonable level of dangerousness, such as available alternative technologies (e.g. wooden bats). I'd like to know what evidence of this type was presented to the jury before I called them "idiots." The writer, however, thinks the jury should have considered the impact of this case across the country. ...
