At the end of the Revolutionary War the Continental Congress (which was the legal government at the time) ordered that the soldiers that were discharged were to be given the rifles they carry during combat. These rifles were to be taken home and kept in good working order, in case of future need for the soldiers to be called upon to return to the army. I believe this are what lawyers call prima facie evidence of a right to bear arm. If the right was given to the state, the arms would have been issued to the state to keep in a central location and issued to men when called up.
