Lerner isn't "on the stand." Dershowitz has a legal opinion. Other lawyers have other legal opinions that Dershowitz disagree with.

It's a legal opinion. The TH authors cited other legal opinions. At the end of the day, if push comes to shove then a judge will make the call.
