Nothing in tort reform restricts the basic right to sue for malpractice. Tort reform is about avoiding frivolous lawsuits by having the loser pay court costs, limiting outrageous "sympathy" awards by juries, and by cutting the costs due to defensive medicine. Defensive medicine is the ordering of unnecessary tests and procedures to protect against possible future lawsuits. By ignoring all the important issues, the author exposed his obvious bias. Since the US is the only country that lacks tort reform, to oppose reform opponents should show that malpractice is much worse in all the countries that have the reforms. Somehow that never comes up.
