'Constitutional Rights' are Human Rights - life, liberty, freedom to own property, freedom from Government, freedom to worship or not worship, protection from invasion etc. Society also have the right to sanction or license certain things within Society. 1) Granting licenses to Medical Doctors, Airplane Pilots, to Drive Automobiles etc. in order to prove knowledge and ability. 2) Granting a Marriage license in order prove age, consent, or incest etc. Society has the right to sanction certain things like Homosexual Marriage. NOTE: Help for Liberals. Sanction means = to authorize, approve, support or allow certain behavior within the Society.

Homosexual Marriage is about a license. There are restrictions on acquiring licenses. Not everyone can acquire a 'Medical' license because there are restrictions. What exactly is a Democracy? In simple terms a Democracy is the 'Majority of the Minute' - that 'Majority of the Minute' will be replaced by the NEXT 'Majority of the Minute' . A Democracy is analogous to a Lynch Mob where everyone has a vote including the one being lynched, but the majority rules, so there are no penalties. Under a Constitutional Republic, those breaking the law by lynching will be met with severe penalties up to and including their own life.
