I think Ken Connor is getting his facts from John Edwards. I agree it takes a greedy plaintif for a greedy trial lawyer to enter a baseless lawsuit, knowing that it is almost always less expensive to settle than to defend even the most outrageous actions. I also disagree that defensive medicine is not an important contributor to medically unnecessary costs.

Perhaps, as some hospitals are doing now, but that could be encouraged by reforming the economics of medical insurance, that medical practioners offer a reasonable warranty to cover the treatments given, the warranty would cover errors and ommisions as well as unsucessful outcomes. Issues arrising from such warrantees could be adjuticated by mediation, followed by...
