currently the only way they can enforce the tax, under the law as written, is by withholding the penalty from any tax refund you may have..... so if you are stroking a check to the IRS they cannot do anything to you because you have no refund to deduct the penalty from. If a smart person was to go to their payroll office and increase the number exemptions indicated on their W4 (most people claim 0 or 1 - increase that 4 and viola no or minimal withholding sent to the gov. in the first place) essentially enables you to be in a position whereby the government has no way to collect the tax. Of course you may end up writing a check for taxes owed in April but they cannot tack on the fine - they can only collect the fine by reducing tax refunds.

The verdict is in, and it's a major disappointment to Obamacare opponents.  CNN initially reported that the individual mandate had been struck down under the Commerce Clause, then corrected its reporting: Obamacare has been upheld as a tax.  It looks like Obamacare's Medicaid expansion has been limited, but not struck down.  Chief Justice Roberts has reportedly joined the Left flank of the Court, authoring the decision (the key bits are on pages 31, 32). 

Confirmed:  The decision was 5-4, with Justices Scalia, Kennedy, Thomas and Alito dissenting. According to SCOTUS blog, the four dissenters were prepared to strike...
