Yes. That's been my prediction for more than 2 years. 5/4 with Kennedy writing. If they uphold it, it could be 5/4 with Kennedy writing for the majority or 6/3 with Roberts writing. I am still in the 5/4 striking down the mandate camp. Kennedy's recent "Ode to Federalism" in US v. Bond and his comments, along with Robert's, at the orals buttress my legal opinion and optimism.
