Dr. Sowell is not flawed in his argument - the "cruel and unusual punishment" analysis does not mix apples and oranges. Dr. Sowell took information from Justice Thomas' dissent (http://www.supremecourt.gov/opinions/09pdf/08-7412.pdf - p.54) which makes the same comparison of juveniles. Credibility is intact.

Homeschool parents/teachers with no college education and only a high school diploma have students who score higher than in public or private school on average. Just thought I'd throw that out there...
