As I read about and study the propose health care program to compete with private health insurance, perhaps the public should be aware of a couple of things. Current health care rules and regulations have been given exemptions by the American with Disabilities Act of 1990; this includes recent amendments to the ADA in 2008. Access to health care does not exist in the ADA. In addition antitrust regulations have given authority to the individual States to regulate health care entities. Given this scenario, it appears the Federal Government would be competing against individual States and its regulators in providing health care services.
